TERMS AND CONDITIONS FOR I'M OUT OF HERE TRAVEL

Welcome to I’m Out of Here Travel, your trusted travel partner. By engaging our services and utilizing our platform, you agree to the following terms and conditions that govern our relationship.

READ ALL YOUR DOCUMENTS PROVIDED BY YOUR TRAVEL AGENT, failure to read them may result in you not having knowledge of arrival, departure, check in and everything that you need to know about your vacation, but it's up to you to read them for all instructions and read the supplier terms and conditions as well. 

I'M OUT OF HER TRAVEL acts ONLY as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”) and is not the source or provider of the travel services. Each of these supplier companies is an independent entity with its own management, and is not under the control of I'M OUT OF HERE TRAVEL. Customer is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and on their companies  Web sites, which govern the transaction. All bookings are accepted by I’M OUT OF HERE TRAVEL as agent for the travel suppliers on your itinerary.

The accommodations, transportation, and other services provided by the identified ground, sea, and flight suppliers are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their Web sites. I'M OUT OF HERE TRAVEL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS, AND DOES NOT HAVE THE CONTROL TO THE OPERATIONS OF INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE  I'M OUT OF HERE TRAVEL  IS NOT LIABLE FOR ANY PROPERTY DAMAGE, PERSONAL INJURY  , WHICH MAY ARISE OUT OF THESE SERVICES. I'M OUT OF HERE TRAVEL  DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, WRONGFUL ACT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL DAMAGES , INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH  IM OUT OF HERE TRAVEL'S OFFICE OR THROUGH THIS WEB SITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF I'M OUT OF HERE TRAVEL CONTROL, AND YOU ABSOLVE   IM OUT OF  HERE TRAVEL FROM ANY LIABILITY WITH RESPECT TO THE SAME. Weather conditions, ALL WEATHER CONDITIONS AND BEACH CONDITIONS INCLUDING SEA GRASS ARE not guaranteed to occur or not occur, outside of I’M OUT OF HERE TRAVEL control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of I'M OUT OF HERE TRAVEL. I'M OUT OF HERE TRAVEL reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time.  IM OUT OF HERE TRAVEL will not assume any responsibility for any air and/or ground schedule changes. IM OUT OF HERE TRAVEL has solely received commission and fees for travel transactions and Customer agrees and understands that any recovery from I'M OUT OF HERE TRAVEL will be limited to the commission and fees paid by Customer actually received by IM OUT OF HERE TRAVEL.  WE RECOMMEND TRAVEL INSURANCE FOR ALL CUSTOMERS.

FORCE MAJEURE (act of God)

“Force Majeure” means, in relation to I'M OUT OF HERE TRAVEL  any situations beyond the reasonable control of IM OUT OF HERE TRAVEL, (including, but without limitation, acts of God,  flood, forceful wind, fire, explosion, or accident, war or threat of war declared or undeclared, acts of terrorism, uprising, riots, strikes, civil disturbance ,sabotage , requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other unforeseen acts or occurrences).  Including trespassing. or not obeying rules provided by the supplier.

I'M OUT OF HERE TRAVEL shall not be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations to the extent that any such delay or non-performance is due to any Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

Regarding civil unrest, once I’M OUT OF HERE TRAVEL has investigated the situation,  it shall remain in I'M OUT OF HERE TRAVEL  sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to I'M OUT OF HERE TRAVEL and each supplier’s terms and conditions.

If I'M OUT OF HERE TRAVEL, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by I'M OUT OF HERE TRAVEL  to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although I'M OUT OF HERE TRAVEL  shall use its reasonable efforts to reimburse you where possible. However, I’M OUT OF HERE TRAVEL  shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to I'M OUT OF HERE TRAVEL  of the Force Majeure and applicable cancellation fees.

 Cancellation policies of Third-Party Suppliers will apply to all bookings, and these may vary depending on the supplier and the nature of the booking. The Travel Agent reserves the right to charge a cancellation fee for its services. Refunds, if applicable, will be processed in accordance with the policies of the Third-Party Suppliers and may be subject to processing fees.

Payments are required at the time of booking; prices availability can vary until payments are secure with suppliers.  Service fees could apply for certain bookings or transactions.  Please read all 3rd party suppliers terms and conditions on any additional fees and please read all your paperwork for fees that will be added on arrival if applicable, these fees are clearly highlighted on the 3rd party quote.  I'M OUT OF HERE TRAVEL RESERVES THE RIGHT TO CHARGE A CANCELATION FEE FOR SERVICES
